These Terms and Conditions (“Terms”) govern your access to and use of the Tender Bulletin website, search tools, accounts, alerts, premium subscriptions, and related services (collectively, the “Services”).

By accessing or using Tender Bulletin, you agree to these Terms. If you do not agree, do not use the Services.

1. About Tender Bulletin

Tender Bulletin is an independent government tender aggregator. We collect, organise, and display tender information from public and licensed sources to help users discover government and related procurement opportunities in South Africa.

Tender Bulletin is not a government department, municipality, state-owned entity, or procurement authority. We do not issue tenders, evaluate bids, award contracts, or act on behalf of any government body.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under South African law to create an account or subscribe to premium services. If you use Tender Bulletin on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

3. The Services

3.1 Free search

Tender Bulletin provides free access to a subset of aggregated government tender listings, search filters, and related information. Free search may be limited in scope, volume, or features at our discretion.

3.2 Premium services

Tender Bulletin premium may include additional listings (such as RFQs and private-sector opportunities), saved searches, email alerts, enhanced filters, and other features described at the time of purchase. Premium features, pricing, and availability may change.

3.3 Information accuracy

We strive to keep Tender Bulletin accurate, current, and useful, but we do not guarantee that any listing, closing date, briefing detail, document link, or source URL is complete, correct, or still available. Tender information originates from third-party sources and may change without notice.

You are responsible for verifying all tender details on the original issuing website or with the relevant authority before relying on any information or submitting a bid.

4. Accounts and security

If you create a Tender Bulletin account, you must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly at hello[at]tenderbulletin.co.za if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms, pose security risks, or are used fraudulently or abusively.

5. Acceptable use

You agree not to:

• use Tender Bulletin for any unlawful, misleading, or harmful purpose;
• scrape, crawl, harvest, or systematically extract data from the Services except as expressly permitted;
• attempt to bypass access controls, rate limits, or premium restrictions;
• interfere with or disrupt the Services, servers, or networks;
• upload malware, spam, or malicious code;
• impersonate Tender Bulletin, a government body, or any other person or entity;
• use the Services to infringe intellectual property or privacy rights;
• resell, sublicense, or commercially exploit the Services or aggregated data without our written consent.

We may investigate violations and take appropriate action, including removing access and reporting conduct to authorities.

6. Third-party links and documents

Tender Bulletin contains links to third-party websites, portals, and documents, including original government tender sources. We do not control and are not responsible for third-party content, availability, security, or practices.

Your use of third-party sites is at your own risk and subject to their terms and policies.

7. Intellectual property

The Tender Bulletin name, branding, website design, software, databases, compilations, and original content are owned by or licensed to Tender Bulletin and protected by applicable intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes in accordance with these Terms. No rights are granted except as expressly stated.

Government tender notices and official documents may remain subject to the rights of their respective publishers or issuing authorities.

8. Subscriptions, billing, and refunds

Premium subscriptions are billed according to the plan selected at checkout. Fees, billing cycles, and payment methods will be disclosed before purchase.

Unless otherwise stated in writing or required by applicable law, subscription fees are non-refundable once a billing period has commenced. You may cancel future renewals according to the cancellation process provided in your account or by contacting hello[at]tenderbulletin.co.za.

We may change pricing or plan features on reasonable notice. Changes will apply to subsequent billing periods unless otherwise stated.

9. Disclaimers

To the fullest extent permitted by law, Tender Bulletin and the Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any tender opportunity will remain open or suitable for your business.

Nothing in these Terms excludes warranties or liabilities that cannot be excluded under South African law.

10. Limitation of liability

To the fullest extent permitted by law, Tender Bulletin and its directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business, or opportunities arising from or related to your use of the Services.

Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to Tender Bulletin in the twelve (12) months before the event giving rise to the claim, or (b) ZAR 500.

Some limitations may not apply where prohibited by law.

11. Indemnity

You agree to indemnify and hold harmless Tender Bulletin from claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.

12. Privacy

Our collection and use of personal information is described in the Tender Bulletin Privacy Policy. By using the Services, you acknowledge that policy.

13. Suspension and termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have breached these Terms, created risk for Tender Bulletin or other users, or where required by law.

You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, and governing law.

14. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. The “Last updated” date above indicates the current version.

If changes are material, we may provide notice through the website or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Subject to any rights you may have under applicable consumer protection laws, you agree to the exclusive jurisdiction of the courts of South Africa in respect of disputes arising from these Terms or the Services.

Before initiating formal proceedings, you agree to contact us at hello[at]tenderbulletin.co.za and attempt to resolve the dispute in good faith.

16. General

• Entire agreement: These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Tender Bulletin regarding the Services.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
• No waiver: Failure to enforce any provision is not a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights as part of a business transfer.
